3. COMMERCIAL TERMS

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

4. COPYRIGHT

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of APIXEL.HK. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

5. ABILITY TO ACCEPT TERMS OF USE

You affirm that You are either over 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. APIXEL.HK is not intended for children under 13. If You are under 13 years of age, please do not use the Website.

6. TERMINATION OF ACCESS

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by APIXEL.HK without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

7. RETURN AND REFUND POLICY

We want to be sure you’re satisfied with your order, which is custom made especially for you. If your order is wrong, misprinted, or it isn’t what you customised, you have 14 days from when the item was shipped to make a return in it's original condition. Give us a shout at apixel.hk@gmail.com and include a picture of the wrong or defective item. We will work with you on a solution which may involve a replacement order, or a refund back to your original payment method.

Refunds for shipped item will be for the cost of the item only, shipping costs are non-refundable. A refund will be sent back to the original form of payment for qualifying item only. All item must be unused, unworn and unwashed and in it's original condition.

8. INDEMNIFICATION

You agree to indemnify and hold APIXEL.HK harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall APIXEL.HK, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
